Draft pending attorney review. These terms describe how the portal is intended to operate. They have not been reviewed by counsel and should be before any firm is asked to agree to them.
What this service is
Hancin Consulting reviews property insurance claim documentation and produces construction estimates and comparison reports. The portal at client.hancinconsulting.com is how engaged firms submit materials and receive those deliverables.
What this service is not
- It is not legal advice, and using it creates no attorney-client relationship.
- It does not interpret insurance policy coverage, adjust a claim, or negotiate with a carrier on behalf of a policyholder.
- It is not a representation that any claim will be paid, or that any particular amount is owed under any policy.
An estimate we produce is a professional opinion of the cost to repair the damage documented in the materials supplied to us. What an insurer ultimately pays is determined by the policy, the carrier and, where applicable, a court or an appraisal panel.
Accounts
Accounts are issued to law firms. You are responsible for keeping credentials confidential, for the actions taken under your account, and for telling us promptly if you believe an account has been compromised. Do not share logins. Tell us when someone leaves your firm so their access can be removed.
Your materials
You keep ownership of everything you upload. You grant us permission to store and process those materials for the purpose of performing the review, including through the service providers described in the privacy policy.
By uploading, you confirm that you are entitled to provide the materials to us and that doing so does not breach an obligation you owe to your client or anyone else.
Our deliverables
Estimates and reports are provided for use in the matter for which they were prepared. They may be produced to a carrier, an opposing party or a tribunal in that matter. They may not be resold or republished as a general work product.
No deliverable is released to your firm until it has been reviewed and approved by a person at Hancin Consulting. Draft or intermediate output visible in the portal before that approval is not a deliverable and should not be relied on.
Accuracy of what you send
Our review is only as good as the file. If material documents or photographs are withheld, incomplete or altered, the resulting estimate may be wrong. We will tell you when we think a file is too thin to support a review.
Fees
Fees are set in the engagement agreement between your firm and Hancin Consulting. These terms do not set fees and do not override that agreement.
Availability
We aim to keep the portal available but do not guarantee uninterrupted service. Maintenance, provider outages and events outside our control can interrupt it.
Limitation of liability
To the extent permitted by law, our liability arising out of the service is limited to the fees paid for the specific engagement giving rise to the claim. We are not liable for indirect or consequential losses, including lost recoveries or lost profits.
Termination
Either party may end the engagement in accordance with the engagement agreement. On termination your firm may request copies of its materials and delivered reports.
Governing law
To be set by counsel. Governing state law and venue for disputes.
